Ashley will moderate a panel discussion entitled ‘Aggressive Advocacy or Unethical Bullying?’ about the balance between permissible advocacy and unethical bullying. Conduct of attorneys, judges, and neutrals will be examined under the ABA Model Rules, the AAA Code of Ethics and the JAMS Ethics Guidelines including how those lines can be crossed. The panelists will discuss these issues from a myriad of perspectives including in-house counsel, trial counsel, arbitrator and mediator. Effective strategies to address these behaviors will also be explored.
