In the News: Joseph Briggett featured in The Bencher

Lugenbuhl shareholder Joseph Briggett recently contributed an article to The Bencher, the official magazine of the American Inns of Court.

The article discusses the ethics of taping conversations with clients, noting the high-profile controversy of attorney Michael Cohen recording conversations with his then-client President Donald Trump.

Most states, as well as federal law, permit one-party-consent recording. Some states' ethics authorities have concluded that the practice is permissable specifically for lawyers, within certain parameters. But determining when it is legal - and when it is ethical - for an attorney to record a phone conversation is a difficult question.

Joseph focuses on several practice areas including commercial litigation and bankruptcy, restructuring, and creditors’ rights. He has achieved success for clients in commercial litigation and complex commercial bankruptcy cases by applying beyond-the-box strategies to difficult and high-risk problems.
