The article, entitled “Consistent Coverage Positions Are A Good Thing—Right?,” examines interesting considerations posed in the case of rePlanet Holdings, Inc. v. Federal Insurance Co. Currently pending in the Eastern District of California, the case “challenged conventional wisdom by permitting an insured to maintain fraud claims against an insurer based on a coverage position claimed to render its crime policy illusory,” says Centner.
