Alicia Bendana to Speak at American Bankruptcy Institute’s 2021 Spring Meeting

03/23/2021

Lugenbuhl shareholder Alicia Bendana will serve as a speaker at the American Bankruptcy Institute’s Annual Spring Meeting. The event will take place April 12-22 returning to a virtual platform similar to the 2020 Insolvency event that took place last fall. Register today!

Bendana will be one of four distinguished panelists to lead a discussion about litigating director and officer claims in bankruptcy on April 20. This panel will explore the use of fiduciary-duty litigation in bankruptcy by dissecting the anatomy of a D&O lawsuit, including the types of claims asserted and their possible defenses. The panelists will also discuss how to analyze D&O insurance policies, and such key issues as whether the proceeds of D&O policies are considered property of the estate. Finally, the panelists will highlight best practices for debtors’ counsel faced with such claims and show how to navigate potential ethical issues.

Bendana will be joined by Leo Oppenheimer of Reid Collins & Tsai LLP, Shane G. Ramsey of Nelson Mullins Riley & Scarborough LLP, and Vincent E, Lazar of Jenner & Block.
